Welcome to Epicure Robotics! These Terms and Conditions outline the rules and regulations for the use of Epicure Robotics Pvt. Ltd.'s website, located at https://epicurerobotics.com/. By accessing an Epicure interface or placing an order, the user agrees to these Terms and to the policies referred to in them. A user who does not agree should not place an order or continue using the relevant interface.

Separate written agreements govern commercial kiosk deployments, rentals, licences, maintenance, manufacturing, supply, partnerships and other business-to-business arrangements. If a separate written agreement applies, it will prevail for that arrangement to the extent of any conflict.

1. Terminology

"Client", "You" and "Your" refer to the person logged on to this website compliant with the Company's terms and conditions. "The Company", "Ourselves", "We", "Our" and "Us" refer to Epicure Robotics Pvt. Ltd. "Party", "Parties" or "Us" refers to both the Client and ourselves. All terms refer to the offer, acceptance, and consideration of payment necessary to fulfil the Client's needs in respect of the Company's services, per prevailing law of India.

2. Eligibility and Authority

A user must be legally capable of entering into the transaction or must use the service with the involvement of a parent, guardian, employer or authorised account holder where required.

A person placing an order through an employer, workplace application, prepaid benefit or third-party account represents that they are authorised to use that account and payment method.

3. Product and Menu Information

Epicure aims to display accurate product names, descriptions, prices, ingredients, nutritional information, allergen information and dietary indicators. The information available at the point of sale should be reviewed before purchase.

Photographs and illustrations are representative. Products made with natural ingredients may have reasonable variation in colour, texture, thickness, sweetness, taste or appearance.

Menu items, ingredients, add-ons, sizes and customisations may vary by kiosk and may change without prior notice.

4. Allergens, Ingredients and Dietary Information

Customers are responsible for reviewing displayed ingredient, allergen, nutrition and vegetarian-status information before confirming an order.

Depending on the menu and preparation environment, products may contain or come into contact with milk, nuts, peanuts, soy, gluten-containing ingredients or other allergens. A customer with a serious allergy should not consume a product where the relevant information is unclear and should contact Epicure before ordering.

Descriptions such as high-protein, no added sugar, vegan, vegetarian or similar claims apply only where specifically displayed for the relevant item and should be read together with the available ingredient and nutrition information.

5. Personalisation and Health Information

Customers must review their product, ingredient, add-on and customisation selections before confirming an order. Epicure is not ordinarily responsible for a product being unsuitable because the customer selected an incorrect option or did not review the displayed information.

Personalisation features, nutritional values and product descriptions are provided for food-selection purposes and do not constitute medical, diagnostic, therapeutic or personalised nutritional advice.

6. Prices, Taxes and Payment

Prices displayed at the point of sale are the prices applicable to the order, subject to correction of an obvious system error before the order is fulfilled.

Prices may include or exclude applicable taxes as stated on the interface or receipt. Payment may be processed by Epicure or by a third-party payment, workplace or employee-benefit platform.

An order is confirmed only when the payment is successfully completed or authorised and the kiosk or ordering platform accepts the order.

7. Availability and Order Acceptance

All orders are subject to product availability, machine condition, ingredient stock, network connectivity and location-specific operating conditions.

Epicure may reject, pause or cancel an order where an item is unavailable, the machine is undergoing cleaning or diagnostics, payment is not confirmed, the transaction appears fraudulent or unsafe, or fulfilment is otherwise not reasonably possible.

Where Epicure cancels a paid order, an appropriate refund or reversal will be initiated under the Order, Cancellation, Refund and Kiosk Fulfilment Policy.

8. Preparation Time and Collection

Any preparation or dispense time displayed in marketing material or on an interface is a typical or estimated time under normal operating conditions and is not an unconditional guarantee.

Actual time may vary because of the product selected, customisations, queue conditions, cleaning cycles, connectivity, machine diagnostics or temporary operational issues.

The customer must collect the product promptly after the kiosk indicates that it is ready. Epicure is not responsible for deterioration, melting, warming, spillage, contamination, theft or loss occurring after the product is made available for collection, except where required by law.

9. Cancellations, Refunds and Quality Complaints

Customer-initiated cancellation, refund eligibility, reporting timelines, investigation and refund processing are governed by Epicure's Order, Cancellation, Refund and Kiosk Fulfilment Policy.

Food-safety concerns, suspected contamination, foreign material, damaged seals or allergic reactions should be reported immediately. Customers should preserve the product and packaging wherever reasonably possible.

10. Safe and Lawful Use of Kiosks

Users must not:

Force open a panel, door, service compartment or restricted machine area;

Place a hand or object inside a restricted or moving part of the kiosk;

Shake, tilt, strike, damage, move or interfere with the kiosk;

Disconnect electricity, networking or safety equipment;

Attempt to access service, maintenance, administrative or diagnostic interfaces without authorisation;

Obstruct cameras, sensors, vents or dispensing mechanisms;

Remove machine parts, stock, packaging or accessories without authorisation;

Introduce any foreign substance, hazardous material or unauthorised item into the kiosk;

Use the kiosk for fraud, unlawful activity, harassment or any unsafe purpose.

Epicure may suspend access, refuse service, notify the premises operator or take legal action where reasonably necessary to protect people, food safety, property or systems.

11. Third-Party Platforms and Premises

Orders may be made available through third-party platforms such as workplace ordering applications, payment providers, wallets, employee-benefit systems or food-service platforms. Their terms and privacy policies may also apply to the services they provide.

Epicure remains responsible for its own food preparation, dispensing and kiosk operations. A third party may be separately responsible for its application interface, account, wallet, payment, employee benefit, network or settlement service.

Access to a kiosk may also be subject to the rules, operating hours, security procedures and access restrictions of the building, workplace, gym, hospital, university, mall or other premises in which it is located.

12. Website and Account Security

Users must not attempt to interfere with the website or applications, introduce malicious code, scrape protected content, bypass security controls, impersonate another person or use another person's account or payment method without authority.

Where Epicure provides customer accounts, the user is responsible for keeping login credentials secure and for promptly reporting suspected unauthorised activity.

13. Intellectual Property

The website, software, user interfaces, robotic systems, designs, text, graphics, trademarks, logos, product names, recipes, videos and other materials owned or licensed by Epicure are protected by intellectual-property law.

Users receive a limited, personal, non-exclusive, non-transferable and revocable right to access the customer-facing service for lawful use. No ownership rights are transferred.

14. Feedback and Customer Content

Where a customer voluntarily submits feedback, photographs, videos, reviews or suggestions, the customer confirms that the submission is lawful and does not infringe another person's rights.

Epicure may use non-confidential feedback to improve its products and services. Epicure will not publish identifiable complaint content for marketing without appropriate permission.

15. Privacy

Epicure's processing of personal data is governed by the Privacy Policy published on the website. Users of third-party platforms should also review the privacy policy of the relevant platform.

16. Service Availability and Changes

Epicure may modify, suspend or discontinue a menu item, kiosk feature, website function or service where reasonably necessary for safety, maintenance, commercial, legal or technical reasons.

Epicure does not warrant that every website function, kiosk or third-party connection will be available without interruption. Epicure will use reasonable efforts to maintain and restore services.

17. Disclaimers

Informational content on the website is provided on an "as available" basis. To the maximum extent permitted by law, Epicure does not warrant that the website will always be uninterrupted or error-free.

Epicure does not exclude liability that cannot lawfully be excluded, including liability arising from fraud, wilful misconduct, death or personal injury caused by negligence, defective products, food-safety violations or statutory consumer rights.

Epicure is not ordinarily responsible for loss caused solely by a customer's incorrect selection, failure to review disclosed ingredients or allergens, misuse of the kiosk, failure to collect a prepared product promptly, or an outage attributable exclusively to an unrelated third-party payment or communication provider, except to the extent otherwise required by law.

18. Limitation of Liability

To the maximum extent permitted by law, Epicure will not be liable for indirect, incidental, special or consequential loss that was not reasonably foreseeable from the relevant transaction.

For a customer claim arising from a specific order, Epicure's monetary liability will ordinarily not exceed the amount paid for that order, except where a higher liability is required by applicable law or arises from a category of liability that cannot lawfully be limited.

Nothing in these Terms limits a consumer's right to seek a statutory remedy from a competent consumer commission or other authority.

19. Indemnity for Misuse

To the extent permitted by law, a user may be responsible for loss or damage caused by the user's deliberate unlawful conduct, fraud, unauthorised access, vandalism or unsafe interference with an Epicure kiosk or system. This clause does not apply to ordinary consumer complaints or lawful exercise of consumer rights.

20. Force Majeure and Events Outside Reasonable Control

Epicure will not be responsible for delay or failure caused by events outside its reasonable control, such as power failure, network outage, building-access restriction, natural disaster, civil disturbance, government action, transport disruption or failure of an independent service provider. Epicure will take reasonable steps to mitigate the effect on confirmed customer orders, including refund or reversal where appropriate.

21. Governing Law and Disputes

These Terms are governed by the laws of India. Subject to non-excludable consumer rights and statutory forums, courts in Bengaluru, Karnataka will have jurisdiction over disputes relating to these Terms.

Customers are encouraged to first contact Epicure so that the complaint can be investigated and resolved promptly. This does not prevent a customer from approaching a competent consumer commission, regulator or other statutory authority.

22. Changes to These Terms

Epicure may update these Terms to reflect changes in law, services or business operations. The updated Terms will be posted with a revised last-updated date. The version displayed when an order is placed will apply to that transaction unless applicable law requires otherwise.
